Abstract
If human tissues and body parts can be treated as property? By analysing a hypothetical dispute between a tissue provider and the recipient research institute, namely Mr X-man v Biotechnology Ltd, and predicting the outcome from a trial court the authors have identified lacunas in the current laws where there are legal uncertainty and inadequate safeguards to the interests of relevant stakeholders of separated human tissues. It is therefore submit that reform in this area of law should be undertaken to address such deficiencies.
